Mr. Jeff Lloyd, Shareholder of the Firm, files U.S. Supreme Court Amicus Brief in high-profile Bilski case
Mr. Jeff Lloyd, Shareholder of the firm, has recently filed a brief with the United States Supreme Court to assist the Court's review of
In re Bilski, a 2008 decision by the U.S. Court of Appeals for the Federal Circuit that will have significant and far-reaching effects on patent law if upheld, and will almost certainly be a landmark decision no matter the outcome. Mr. Lloyd's brief, filed on behalf of
amicus curiae the University of South Florida, is primarily directed to demonstrating how the Federal Circuit's decision is contrary to the intent of the Framers of the Constitution and the legislative history of the Patent Act. Evidence supporting Mr. Lloyd's contention that the Framers considered medicine one of the "useful arts" and thus eligible for patent protection is drawn from the Letters of Thomas Jefferson, the first edition of the Encyclopedia Brittanica, and Cullen's First Lines of Physic, a prominent 18th Century medical textbook. The brief can be found at [link]. The Supreme Court will hear arguments in the case,
Bilski v. Kappos, Docket No. 08-964, on Monday, November 9, 2009.
